The High Court could not disregard material admissions
The vehicle owner admitted employment in testimony. He later confirmed the admission in an affidavit before the Court. The admission addressed the central disputed relationship. The Commissioner had already considered the owner’s evidence. The High Court relied instead on the earlier denial. The Supreme Court found this approach erroneous. Material admissions must be considered with the record as a whole. Failure to do so may undermine the resulting conclusion. Panganti Vijaya v. United India Insurance Company Ltd. & Ors. | 2026 INSC 9
