Distinction between bona fide procedural misunderstanding and culpable professional negligence
Professional misconduct entails a deliberate breach of ethical standards, intentional fraud, corrupt practice, or gross moral delinquency, and must be strictly distinguished from inadvertent procedural lapses or mutual misunderstandings regarding the deposit of court-directed costs. Where an advocate takes subsequent corrective legal steps to recall an adverse dismissal order, successfully secures the reduction or waiver of enhanced costs, and eventually obtains the ultimate relief of quashing criminal proceedings for the client, the initial lapse cannot be characterized as contumacious dereliction of professional duty. An advocate who diligently remedies an administrative impediment cannot be branded guilty of grave professional misconduct in the absence of mens rea or fraudulent design.
