Judicial rectification of inadvertent defaults and client protection
The inherent and statutory powers of the High Court to restore recalled quashing petitions and modify cost conditions demonstrate the judicial system's flexibility in correcting inadvertent lapses without prejudicing the underlying cause of justice. When the High Court accepts the explanation for non-deposit of costs, recalls a dismissal order passed for want of prosecution, and ultimately quashes the criminal proceedings on merits pursuant to a settlement, any initial detriment suffered by the client stands entirely cured. In such circumstances, where the client experiences no substantive injury and achieves the desired legal result through the continued professional efforts of the counsel, a punitive disciplinary sanction against the advocate is contrary to justice and equity.
