Harmful impact of premature police intervention in matrimonial disputes
Initiating police complaints and criminal proceedings at the earliest sign of matrimonial discord frequently destroys any remaining window of reconciliation between spouses. Close relatives and family members often exacerbate minor differences and trivial domestic quibbles into major conflicts by rushing to law enforcement agencies. The involvement of police machinery in sensitive marital disputes introduces an element of irreversible hostility and mutual hatred that precludes future harmony. Every minor annoyance or day-to-day disagreement between a couple does not constitute legal cruelty and should be handled through mature dialogue or counseling rather than penal statutes. Resorting to criminal complaints, such as under Section 498A of the Indian Penal Code, cannot be utilized as a coercive tool to hold a spouse to ransom or exert economic pressure. A hyper-sensitive and aggressive approach towards mundane marital frictions severely damages the foundational values of tolerance and mutual adjustment required in a marriage. (Neha Lal v.
