Encouragement of pre-litigation mediation and early dispute resolution

Emphasizing institutional mechanisms like pre-litigation mediation is essential to curb the alarming rise in adversarial matrimonial litigations clogging the judicial system. Courts have consistently noted that warring couples should be directed towards structured conciliation and mediation centers at the very threshold of their marital friction before filing formal court cases. Early mediation offers a conducive and peaceful environment where trained mediators can help parties communicate constructively and explore amicable separation or reunion. When disputes are allowed to fester and multiply into dozens of cross-cases, the psychological barrier to settlement increases exponentially. Establishing robust pre-litigation counseling frameworks across all districts helps filter out trivial disputes and prevents families from getting trapped in prolonged court battles. Encouraging amicable resolutions safeguards the emotional well-being of the parties and preserves judicial resources for genuine legal controversies. (Neha Lal v. Abhishek Kumar | 2026 INSC 73)
