A transferee during pending litigation takes subject to the result

The suit for specific performance was instituted before later transfers. The plaintiff also registered lis pendens. The judgment debtor transferred portions of the suit property during the suit. Purchasers therefore acquired interests while the litigation was pending. Section 52 of the Transfer of Property Act was central to the dispute. Such transfers cannot defeat the rights ultimately declared in the suit. The transferee’s position remains subject to the decree. The Court applied this principle to the subsequent purchasers.
