Lis pendens protects the effectiveness of pending property proceedings
The plaintiff sought a decree for execution of a sale deed and possession. Lis pendens was registered shortly after the suit began. The property was transferred to several purchasers during the proceedings. The doctrine prevents parties from frustrating litigation by alienation. A purchaser pendente lite cannot claim an unrestricted independent title. The transfer remains subject to the result of the suit. This protects the court’s ability to grant effective relief. The Court considered the doctrine in resolving execution disputes. Alka Shrirang Chavan & Anr. v. Hemchandra Rajaram Bhonsale & Ors. | 2026 INSC 52
