A decree for specific performance can be executed through the court
The civil court directed the defendant to execute a sale deed. The decree permitted execution through a court commissioner if he failed. The defendant did not comply within the prescribed period. Execution proceedings were therefore initiated by the decree holder. The commissioner executed the sale deed under court orders. A judgment debtor cannot defeat the decree through non-compliance. Court-assisted execution gives effect to the adjudicated right. The subsequent challenges were considered against this procedural history. Alka Shrirang Chavan & Anr. v.
