Execution proceedings cannot be used to reopen concluded merits

The original suit resulted in a decree for specific performance. A court commissioner later executed the sale deed. The judgment debtor sought cancellation through execution-related applications. The dispute had already passed through several rounds of litigation. Execution jurisdiction must be exercised within its legal limits. It cannot become an unrestricted opportunity to relitigate the decree. The Court considered finality and the history of prior proceedings. It issued directions to prevent further repetitive litigation. Alka Shrirang Chavan & Anr. v. Hemchandra Rajaram Bhonsale & Ors. | 2026 INSC 52
