Each accused’s case must be assessed individually
The appeal concerned only Jaswinder Singh. The Court confined its scrutiny to the evidence against him. The other accused were alleged to have committed the shootings. The Court did not decide the sufficiency of evidence against them. The appellant’s alleged role was distinct from the alleged shooters. Individual liability requires evidence directed to the individual accused. The Court expressly limited its findings to this appellant. Its decision did not determine the other accused persons’ cases.
