Protection of bona fide third-party rights created through registered conveyances
Commercial premises and office units purchased by bona fide third parties for valuable consideration under registered sale deeds acquire distinct legal protections that cannot be lightly disrupted by collateral litigation. When purchasers invest substantial sums and pay requisite stamp duties and registration charges in reliance upon validly issued occupation certificates and commercial licenses, their crystallized proprietary rights must be safeguarded. Any blanket or coercive judicial action affecting large commercial complexes must account for the presence of numerous independent, innocent third-party owners who were never party to the initial administrative challenge. Protecting third-party interests ensures economic stability and prevents collateral damage to innocent market participants. (Raj Singh Gehlot & Ors. v. Amitabha Sen & Ors. | 2026 INSC 77)
