Trial expedition and witness attendance

The Court stressed that detention must accompany meaningful trial progress. The Trial Court was directed to proceed with due expedition. Examination of protected prosecution witnesses was specifically emphasised. The prosecution must take steps to secure witness attendance. Parties should avoid adjournments except for unavoidable reasons. The Trial Court may regulate proceedings lawfully to prevent unnecessary delay. Expedition must remain consistent with fairness and the rights of all parties. These directions express no view on the merits of the prosecution case. (Gulfisha Fatima v.
