Limited inquiry at the bail stage

The Court does not conduct a full trial when deciding bail. Prosecution material is assessed within the statutory limits governing bail. The Court makes no final finding on guilt or innocence. Observations are confined to the present record and the bail question. The merits remain for adjudication at trial. Serious allegations alone do not replace the statutory inquiry. The test is applied to each accused’s record and role. The judgment cautions against treating bail findings as a verdict. (Gulfisha Fatima v.
