Bail under the special UAPA framework
Section 43D(5) of the UAPA establishes a distinct bail regime. The Court asks whether the accusation appears prima facie true on prosecution material. The inquiry at bail stage is limited and is not a full trial. The statutory restraint ordinarily applies when its threshold is met. The Court cannot apply the restriction mechanically. Nor can liberty be invoked to erase the statutory condition. The statute must be applied consistently with constitutional guarantees. The judgment treats this as disciplined judicial scrutiny.
