Adjudicating authority section 60 5 ibc jurisdiction limited disputes arising solely relation insolvency proceedings
The jurisdiction conferred on the National Company Law Tribunal under Section 60(5)(c) of the Insolvency and Bankruptcy Code, 2016 is strictly defined by the requirement of a direct nexus with the insolvency resolution process. The Adjudicating Authority cannot usurp the legitimate jurisdiction of ordinary civil courts, trademark registries, or statutory tribunals to determine complex title disputes or third-party property rights that do not arise solely out of or in relation to the insolvency of the corporate debtor. Where an approved resolution plan acknowledges rival ownership claims over an asset rather than establishing an undisputed title, the NCLT lacks residuary jurisdiction to grant a final declaration of title in favor of a successful resolution applicant.
