Constitutional courts must provide expeditious effective remedies enforcing child right education claims
Constitutional and civil courts are duty-bound to provide easy access and efficient, time-bound relief to parents complaining of the denial of admission rights under the RTE Act, ensuring that judicial delay does not render statutory entitlements infructuous. Because a child's foundational education cannot be paused during protracted litigation, courts must exercise proactive oversight and enforce strict timelines against non-responsive neighbourhood schools and local authorities. When individual relief becomes temporally unfeasible, constitutional courts retain the jurisdiction to lay down systemic procedural directions to prevent recurring administrative default and safeguard future cohorts of disadvantaged students.
