State Power to Sanction Errant Establishments and the Equitable Protection of Ongoing Patients
Clinical establishments and corporate facilities that systematically promote, advertise, or administer unproven and unapproved cellular interventions operate in flagrant breach of the regulatory regime and are liable to stringent statutory penalties. Appropriate licensing authorities are legally empowered and mandated to institute proceedings under Sections 32 and 40 of the Clinical Establishments (Registration and Regulation) Act, 2010 to effectuate the suspension, cancellation of operating registrations, and imposition of financial penalties against errant establishments. However, in recognizing the acute human vulnerabilities involved, courts exercising equitable jurisdiction must balance the immediate prohibition of illicit commercial practices against the welfare of existing patients mid-treatment. The State is obligated, through specialized administrative mechanisms and institutional healthcare bodies, to formulate controlled transition strategies that re-route ongoing patients into regulated clinical trial settings to prevent harmful setbacks while completely dismantling unapproved commercial offerings.
