Mandatory Statutory Force of National Ethical Guidelines via Delegated Legislation

The National Ethical Guidelines for Biomedical and Health Research Involving Human Participants, 2017 enjoy full statutory force and legal enforceability through their incorporation into Rules 15 and 16(4) of Chapter IV of the New Drugs and Clinical Trials Rules, 2019. Consequently, research and clinical applications involving human subjects that fall outside the "new drug" classification must scrupulously conform to Clauses 4.2.4 and 7.9.1 of the National Ethical Guidelines. These binding provisions mandate that, save for hematopoietic stem cell reconstitution for recognized hematological indications, any therapeutic application of stem cells is legally categorized as research that must be executed strictly within an approved, institutional-committee-reviewed clinical trial protocol. Offering such cellular interventions as clinical treatments outside these monitored parameters directly violates the statutory scheme governing biomedical and health research.
