Evidentiary Weight and Interpretative Authority of National Guidelines and ICMR Publications
The scientific guidelines and evidence-based reports published by the Indian Council of Medical Research (ICMR) under the auspices of the Department of Health Research (DHR), including the National Guidelines for Stem Cell Research, 2017 and the Evidence Based Status of Stem Cell Therapy for Human Diseases, 2021, serve as authoritative baselines for determining acceptable medical standards in the country. Even though such publications may originate from autonomous or non-statutory origins, they represent the apex scientific and ethical consensus on contemporary biomedical developments. In evaluating whether a challenged clinical practice constitutes sound medical judgment or culpable negligence, courts must accord decisive evidentiary weight to these authoritative findings over unvetted private opinions. Because ICMR guidelines conclusively categorize any administration of stem cells for ASD outside approved research as unethical malpractice, practitioners who ignore these parameters act contrary to the accepted baseline of medical care.
