Claims of higher-merit candidates under the Mukesh Kumar Tailor precedent
Following the retention of previously appointed teachers despite lower marks in the revised list, candidates who secured higher marks than those retained approached the High Court by filing writ petitions represented by Mukesh Kumar Tailor. Based on a fair stand and formal concession taken by the State Government, the High Court directed the State to calculate available vacancies across Zila Parishads and call candidates in a one-is-to-two ratio for document verification to make appointments according to merit. This framework established that candidates who achieved higher marks than the last retained appointee must be accommodated against existing vacancies. (The State of Rajasthan & Ors. v. Namonarayan Sharma & Ors. | 2026 INSC 179)
