Fair procedure matters when cancelling an existing allotment

BIADA issued show-cause notices proposing cancellation. The notices referred to the need for land for IIT Patna. The allottee responded that the legal power to cancel had not been cited. The allottee also described expenses incurred after taking possession. A fair process requires more than announcing a public purpose. The authority must act under law and consider the affected party’s position. The Court restored the Single Judge’s order. The cancellation could not stand as ordered.
