Role of disciplinary bodies as custodians of professional conduct rather than mechanical arbiters

While the Bar Council of India and State Bar Councils are entrusted with upholding the integrity, dignity, and ethics of the legal profession, they must not exercise their disciplinary jurisdiction in a pedantic, rigid, or mechanical manner. The true objective of disciplinary oversight is to penalize unethical exploitation, professional depravity, and harmful practices, rather than penalizing advocates whose clients have explicitly acknowledged their diligence, resolved all misapprehensions, and affirmed their professional competence under oath. Disciplinary committees must take a holistic view of the advocate-client relationship and refrain from persecuting members of the Bar when the initiating party has completely disowned the allegations.
