Return of the papers as a condition of refund
The refund was not ordered without a corresponding step by the petitioner. The petitioner must return the stamp papers received from respondent no. 1. Only upon return must the State refund ₹3,99,100. This condition avoids retention of both the papers and their monetary value. The State must complete payment within two months. The condition forms part of the operative order. The judgment links monetary restoration with return of the physical instruments. The exact terms govern compliance. (Dharmendra Sharma v. M.
