Relevant former officials may be summoned as prosecution witnesses

The Interim Resolution Professional was permitted to seek witness summons. The potential witnesses included former officials and directors. They were to be persons responsible for or familiar with the matter. Their knowledge had to relate to the subject of the alleged offence. The direction did not declare their evidence proven in advance. It enabled the complainant’s representative to request their examination. The trial process would determine the relevance and value of evidence. The Court’s order concerned procedural participation and witness access. Smt. Shalini Bhateja & Anr. v.
