Body-specific nature of statutory authorization under Section 433 of the Companies Act, 2013

Statutory provisions that explicitly extend the provisions of the Limitation Act, 1963 to specific forums, such as Section 433 of the Companies Act, 2013 applying to the NCLT and NCLAT, are institution-specific and operate prospectively from the date of their commencement. Such powers cannot be borrowed, backdated, or retroactively applied to predecessor quasi-judicial bodies like the Company Law Board that functioned prior to the enforcement of the enabling provision. The deliberate legislative timing of bringing Section 433 into force concurrently with the establishment of the NCLT confirms that predecessor bodies lacked such jurisdiction.
