Failure to cite a statutory provision does not alone prove bad faith

The four questioned bail orders did not refer to Section 59-A. Other orders by the officer had referred to that provision. The authority inferred awareness from the other orders. The Court examined whether omission in four orders proved corrupt motive. A missing statutory reference is not, by itself, proof of dishonesty. The context and evidence must support any inference of bad faith. The Court found the inference inadequate on the facts. The removal could not rest solely on that omission. Nirbhay Singh Suliya v.
