Dying declaration recorded competent magistrate voluntary truthful inspires full confidence forming sole basis conviction
Under Section 32(1) of the Indian Evidence Act, 1872, a dying declaration recorded by a competent Magistrate or Executive Magistrate after obtaining medical certification of mental fitness stands on a high evidentiary footing and can form the sole basis of conviction under Section 302 IPC without requiring independent corroboration. Courts must evaluate whether the declarant was in a fit mental state, conscious, and free from tutoring, coercion, or manipulation at the time of making the statement. Minor discrepancies regarding the exact time of recording or procedural assistance provided during dictation do not invalidate an otherwise voluntary, truthful, and consistent dying declaration.
