Lapse of Proceedings and Right to Immediate Restitution of Retiral Dues
When departmental proceedings are instituted post-retirement without statutory sanction or jurisdictional authority, the inquiry and all consequential punitive or recovery orders are deemed non est in the eyes of the law, resulting in the total lapse of the disciplinary action. In such events, the superannuated employee is entitled as a matter of right to the full and immediate release of all withheld retiral benefits, including gratuity, provident fund, and leave encashment. Furthermore, the employer is legally obligated to effect complete restitution by refunding any pecuniary sums improperly deducted or recovered from the employee during the pendency of the invalid proceedings within a stipulated timeframe.
