Eyewitness identification must be considered with the full testimony

PW-7 identified the two alleged shooters in court. His evidence about the appellant was mainly that he drove the vehicle. A further allegation about dragging the victim had not been recorded earlier. PW-10 likewise spoke of the appellant driving the vehicle. The Court considered both witnesses’ statements in context. Identification in the dock did not by itself fill the evidentiary gaps. The testimony did not establish the appellant’s role in the crime proper. The total evidence was insufficient to sustain his conviction. Jaswinder Singh @ Shinder Singh v.
