Distinction Between Career Progression Rules and Recruitment Rules
There exists a clear legal distinction between Career Advancement Scheme (CAS) regulations and general public recruitment rules governing initial entry into service. Career progression regulations are specifically structured to facilitate the internal promotion and grade elevation of incumbent and newly appointed academic staff based on accumulated service records. The evaluation framework under CAS, including Academic Performance Index (API) scores and weightage tables, presupposes pre-existing teaching experience, research output, and institutional contributions within the system. These metrics cannot logically or practically be applied to outside aspirants seeking initial appointment through an open competitive selection process. Using a regulatory framework designed for internal career progression as a gatekeeping mechanism for initial public employment distorts both the text and purpose of the regulations. Direct recruitment entry levels mentioned within career advancement schemes merely specify how internal staff enter the promotional ladder, rather than defining open public recruitment protocols. Applying promotional standards to direct recruitment converts a rule meant as an internal advancement ladder into an unauthorized barrier to entry. Courts must preserve the fundamental difference between rules that initiate a career and those that advance an existing one. (Gujarat Public Service Commission v.
