Correction of indirect bail cancellation through supreme court intervention

The Supreme Court will unhesitatingly exercise its appellate jurisdiction to set aside orders of the High Court and Sessions Court that indirectly cancel bail under the guise of granting police custody remand. When lower forums fail to observe settled legal parameters governing bail and remand, resulting in an unjust curtailment of liberty, apex court intervention becomes imperative to restore legal order. Allowing flawed revisional directions for police custody to stand would establish a dangerous precedent where bail orders could be routinely circumvented by investigating agencies. By quashing such unsustainable orders, the Supreme Court reaffirms the binding nature of bail grants and enforces strict procedural discipline across subordinate courts. This corrective intervention ensures that investigating agencies strictly adhere to lawful channels—such as formal bail cancellation petitions—rather than resorting to indirect custodial demands. Consequently, setting aside perverse remand orders safeguards the constitutional rights of the accused and maintains the integrity of the criminal justice system. (Pogadadabnda Revathi & Anr. v.
