Protection of fundamental rights under Article 32 against administrative high-handedness

The extraordinary jurisdiction of the Supreme Court under Article 32 of the Constitution of India provides a direct constitutional remedy to citizens whose fundamental rights are infringed by arbitrary state action and institutional bias. Aggrieved individuals who have been subjected to protracted administrative persecution, illegal forced retirement, and deliberate denial of promotional or statutory appointments are fully entitled to invoke this original jurisdiction. The apex court will exercise its expansive powers to issue writs of certiorari, mandamus, or appropriate directions to quash biased selection committee minutes, direct fresh consideration within strict timeframes, and eliminate executive obstacles. This constitutional safeguard ensures that state machinery cannot crush individual rights through prolonged legal and administrative warfare. (Captain Pramod Kumar Bajaj v. Union of India and Anr. | 2026 INSC 101)
