Representative capacity impleadment land acquisition challenges prohibited without explicit pleadings

A few land owners cannot be impleaded in a representative capacity to bind all beneficiaries of a land acquisition award without explicit pleadings and procedural compliance. Land owners participating in statutory acquisition proceedings hold distinct individual rights regarding their respective property parcels and compensation determinations. Judicial proceedings challenging compensation awards must implead all affected land owners individually if their statutory rights are sought to be altered or annulled. Courts cannot presume representative impleadment merely because multiple land owners derived compensation under a single composite acquisition notification. Failure to implead individual land owners in writ petitions seeking setting aside of compensation awards renders resultant cancellation orders totally inoperative against omitted land holders. Statutory rights to acquire property compensation cannot be defeated through proxy representation or selective party impleadment in public interest or governmental litigation. Thus, judicial proceedings seeking award setting aside bind only those specific land owners explicitly arrayed as party respondents in the pleadings. (Niraj Jain v.
