Restoration of interim protection upon correction of appellate misinterpretations
When a High Court erroneously vacates an interim injunction granted under Section 9 of the Arbitration and Conciliation Act, 1996 by incorrectly calculating the date of arbitral commencement from the filing of a Section 11 application rather than from the receipt of the Section 21 notice, such a judgment is legally unsustainable. The Supreme Court will set aside the erroneous High Court ruling and restore the trial court's original ad-interim injunction to preserve the subject matter of the dispute while directing the expeditious disposal of pending arbitrator appointment petitions.
