Harmonious construction of procedural court rules with parent arbitration act

High Court procedural rules framed under Section 82 of the Arbitration and Conciliation Act, 1996, such as rules providing for the automatic vacation of interim orders if arbitration is not initiated within specified time limits, must be interpreted in complete harmony with the parent provisions of the Act. Where a procedural rule uses the expression "initiated" regarding arbitral proceedings, it must be read as synonymous with "commenced" within the meaning of Section 21 of the Act. Interpreting procedural rules to require something separate from or beyond Section 21 commencement would undermine the parent statute and create impermissible procedural contradictions.
