Finality of uncontested findings regarding agreement existence and partner consent

Where a High Court renders a specific finding in an appeal under Section 37 or Section 9 confirming the existence of a valid franchise agreement and the implied or explicit consent of partnership firm members, and that finding is not challenged by the aggrieved party through a cross-appeal or cross-objections before the Supreme Court, the finding attains absolute finality. Parties are legally precluded from re-agitating settled factual questions regarding agreement validity or lack of partner consent in collateral or subsequent stages of the same appellate litigation.
