Distinction between trigger for arbitration and judicial remedial mechanisms

A fundamental legal distinction exists between the statutory trigger that commences arbitral proceedings under Section 21 and the judicial remedial mechanisms provided under Section 11 of the Arbitration and Conciliation Act, 1996. The issuance and receipt of a notice invoking arbitration constitutes the complete trigger that sets arbitration in motion. Filing a Section 11 petition before a High Court or the Supreme Court is merely a secondary, remedial measure necessitated only when a party refuses to cooperate or fails to concur in the appointment of an arbitrator following the receipt of a Section 21 notice.
