Non-Maintainability of Belated Applications Seeking to Set Aside Delivery of Possession
Where the executing court has accepted the report of the court commissioner and the court bailiff confirming the delivery of possession of the decreetal property and has formally disposed of the execution proceeding on recording full satisfaction, a subsequent application under Section 47 seeking to undo or set aside such delivery is entirely non-maintainable. A judgment-debtor cannot remain indolent throughout the execution proceedings, permit the delivery of possession to be accomplished without demur, allow the court to record complete satisfaction, and thereafter file a belated miscellaneous application under Section 47 alleging erroneous or mistaken delivery of a different plot. Permitting such belated applications after the decree has been completely satisfied undermines the certainty and finality attached to judicial execution orders. The executing court commits a grave jurisdictional error if it entertains an application under Section 47 after the execution proceeding has already been formally closed and satisfied.
