Evidentiary Weight and Finality of Unobjected Court Commissioner Reports

A report submitted by a duly appointed Civil Court Commissioner detailing the demarcation of property and the actual delivery of possession carries significant evidentiary weight and presumptive correctness, particularly when corroborated by the official report of the court bailiff. When such demarcation is carried out on the spot in the physical presence of the parties, official amins, and independent witnesses, it reflects an authentic execution of the decree in terms of the schedule. If neither the decree-holder nor the judgment-debtor files any objection against the commissioner's report within the time permitted by the executing court, the court is fully justified in accepting the report and treating the decree as fully satisfied. The failure of the judgment-debtor to tender timely objections amounts to acquiescence in the commissioner's findings, and the executing court’s order accepting the report closes all factual inquiries into the physical demarcation and identity of the land.
